RE: Logo for cannabis product labeling, marking, stamping, and imprinting

All Licensees,

The following information and materials are offered as guidance to licensees so they may satisfy requirements listed in 16.8.3 NMAC Packaging, Labeling, Advertising, Marketing, And Commercial Display Requirements For Cannabis Products.

Any cannabis finished products available for retail sale ON or AFTER April 1, 2022 will need to be labeled and imprinted according to the Division’s rules and regulations and the guidance provided herein.

In regard to the rule 16.8.3.9 NMAC Cannabis Finished Product Labeling and 16.8.3.12 NMAC Cannabis Finished Product Packaging only the relevant sections have been provided for reference to clearly furnish guidance and clarification on compliance with cannabis finished product packaging and labeling.

Rule:

16.8.3.9 NMAC Cannabis Finished Product Labeling:

A. Unless otherwise provided, cannabis finished products shall meet the minimum labeling
requirements of this section.

K. The principal display panel shall include:

4) A logo designed and provided by the division that notifies a reasonable person that the product contains cannabis that is no smaller than ½ inch by ½ inch.

Division Guidance:

The logo specified in sub-section K(4) of 16.8.3.9 NMAC CANNABIS FINISHED PRODUCT LABELING is displayed in Appendix A of this document and will be made available on the Cannabis Control Division website, https://ccd.rld.state.nm.us/. This logo will be used for both medical and retail cannabis product labeling, marking, stamping, and imprinting.

Rule:

16.8.3.12 NMAC Cannabis Finished Product Packaging

A. Unless otherwise specified, edible or topical cannabis finished products shall meet the
following minimum packaging requirements:
. . .

(8) edible cannabis finished products containing multiple servings in a single container shall:

(a) when in in solid form, be:
(i) easily separable in order to allow an average person 21 years of age or older to physically separate, with minimal effort, individual servings of the product; and
(ii) easily and permanently scored to identify individual servings;
(b) be packaged in a single serving size; and
(c) be marked, stamped, or otherwise imprinted with a logo designed and provided by the division that notifies a reasonable person that the product contains cannabis that is no smaller than 1/2 inch by 1/2 inch for each single serving contained in a multi-serving package

Division Guidance:

The logo specified in sub-section (A)(8)(c) of 16.8.3.12 NMAC Cannabis Finished Product Packaging is displayed in Appendix A of this document and will be made available on the Cannabis Control Division website, https://ccd.rld.state.nm.us/. This logo will be used for both medical and retail cannabis product labeling, marking, stamping, and imprinting.
