Personal Use of Cannabis

A single adult, 21 years of age or older, can grow up to 12 plants at their private residence, but no more than six (6) plants can be mature, flowering plants. A household with multiple adults can have no more than 12 mature plants total.

Homegrown cannabis is intended exclusively for the personal use of the resident. New Mexico law prohibits the sale of cannabis or cannabis products by anyone not licensed to sell and cannabis cannot be used to trade or barter for other goods or services. Violators of the law are subject to a penalty ranging from a $50 fine to fourth degree felony charges.

If you live in a home where children or pets live or visit, it is critical that precautions be taken to ensure they do not have access to cannabis plants. Ingestion of cannabis by children or pets can result in serious health consequences and possibly criminal consequences for the adult homeowner.
