Endowed Care Cemeteries

The Financial Institutions Division does not license or regulate the operations of any cemeteries, including endowed care cemeteries, municipal cemeteries, fraternal cemeteries, religious cemeteries, or family burial grounds.

Endowed care cemeteries are privately owned cemeteries that register with the State of New Mexico to establish an irrevocable trust fund to maintain the general upkeep of the cemetery grounds.  This includes mowing lawns, trimming shrubs, cutting trees, and keeping in repair roads, buildings, fences, and other structures as prescribed in the New Mexico Endowed Care of Cemetery Act § 58-17-1, et seq., NMSA 1978.

The endowed care cemeteries are required to file an initial registration followed by an annual registration statement every year thereafter.  See the forms and applications section of our website for additional information.
