Alcoholic Beverage Control

In compliance with the Liquor Control Act, the Alcoholic Beverage Control Division (ABC) issues, transfers and revokes liquor licenses. We also administer the Alcohol Server Training Program, educating Licensees and Servers to prevent the sale of alcoholic beverages to minors and intoxicated  persons.

On July 1, 2020, we began regulating the newly established Tobacco Product Act to ensure that establishments and employees are selling tobacco and tobacco products in compliance with the new law and preventing the sale of these items to New Mexicans under the age of 21.

Our primary responsibility is to protect the health, safety and welfare of all New Mexicans and those visiting our State, while regulating sale, service and public consumption of alcohol and tobacco and/or tobacco products.

Expanded Temporary Outdoor Dining EXTENDED to 10/31/2022

The Temporary Expansion of Outdoor Patio Dining space due to Covid-19 restrictions has been extended to October 31, 2022.  The Division’s Extension is effective so long as it complies with your individual Local Option District’s requirements.

  • There is no additional fee for Temporary Floor Plans already approved and Licensee does not have to resubmit documentation.
  • Please note that your Local Option District retains jurisdiction for extensions and waivers to local ordinances, fire code compliance and local land use concerns.

Public Hearing. The Division held a Public Hearing on Monday, July 26, 2021 from 1:00 p.m. to 5:00 p.m. held virtually, due to the concerns surrounding COVID-19. Attendees were able to provide public comment on record and submit written comments.

shipping or transport for Personal use; military personnel

The State of New Mexico has no objection to service members or an individual bringing a reasonable amount of alcohol into the State for personal consumption only -see NMSA 1978 60-7A-3D Transportation into state without permit; exportation of alcoholic beverages without permit; importation for private use; reciprocal shipping; when unlawful.

Pursuant to NMSA 1978 7-17-5 Imposition and Rate of Liquor Excise Tax, per the New Mexico Taxation and Revenue Department, no excise tax would be due on alcohol transported into the State by an individual for personal consumption.

Shipping or transporting for personal use is authorized in New Mexico and a copy of the memo can be provided to your common carrier.
