Notice of Rule Hearing on Elevator Safety Act 7/21/25

The New Mexico Regulation and Licensing Department’s Construction Industries Division will hold a public rule hearing at 9:30 a.m. MST on July 21, 2025 to hear public comments regarding permitting and certificate of operation fees for commercial conveyances (elevators, escalators, etc.) pursuant to the Elevator Safety Act, 60-13B-1 to 60-13B-15 NMSA 1978.

Conveyance Registration

By January 1, 2026, all commercial conveyance(s) in New Mexico must be registered with the Construction Industries Division (CID) as required by the Elevator Safety Act.

The Elevator Safety Act, passed during the 2023 New Mexico legislative session, will ensure the safety of all publicly accessible conveyances in New Mexico by requiring the annual inspection of existing conveyances and the permitting and inspection of new installations to certify code compliance.

Before completing the registration form, you will need the following information (If you do not possess this information, please contact the property owner or installer/maintenance company of the conveyance to obtain the required information):

• Type of conveyance (elevator, escalator, etc.)
• Purpose of conveyance (passenger or freight)
• Manufacturer and OEM job number
• Rated speed and capacity
• Physical location of conveyance
• Contact information for person responsible for maintaining conveyance

This memorandum serves as notice to all mechanical industry related companies of the change in upcoming refrigeration requirements. The Environmental Protection Agency has issued a notice that equipment utilizing R-410 refrigerant will not be manufactured or shipped after December of 2024. 

Due to this change, CID and all other local municipalities will be enforcing the requirements listed below from the 2024 Uniform Mechanical Code for A2Ls refrigerants. This memorandum will remain enforce until the Mechanical Bureau adopts the 2024 Uniform Mechanical Code.
